In this regard, the Article 29 Working Party in its Opinion 4/2012 (Opinion 4/2012 on the exemption from the consent requirement for Cookies, http://ec.europa.eu/justice/data-protection/article-29/documentation/opinion-recommendation/files/2012/wp194_en.pdf) has interpreted that among the exempted cookies would be those with the purpose of:
- ‘User input’ cookies
- Authentication or user identification cookies (only session)
- User security cookies
- Session cookies for multimedia player
- Load balancing session cookies
- User interface customization cookies
- Plug-in cookies for social content exchange
Thus, it can be understood that these cookies fall outside the scope of Article 22.2 of the LSSI, and therefore, it would not be necessary to inform or obtain consent for their use.
